STOP THIS: ATF Pistol Brace Proposal 2021R-08

The ATF is proposing that short-barreled pistols with “stabilizing braces” which are perceived as being used as shoulder braces, be banned. This action, if passed, will make up to 22 million Americans felons, unless a longer barrel is attached and a $200 tax stamp is paid and strict process followed, or the firearm is destroyed or turned in.

Only Congress can define these terms, if it were to be a law. The ATF can put forth regulations, but not laws.

Direct tax unapportioned among the States by population is forbidden by the Constitution of the United States.

To demand a tax on property previously purchased, albeit legally, even so with the guidance of the ATF itself, is unconstitutional. The ATF previously approved the “stabilizing brace”, and cannot successfully pass through Congress the taxing and/or banning of such a device with the effect of instantaneously or retroactively causing millions of law-abiding Americans to be considered felons or criminals, and cannot confiscate such multitude of property.

The Hobbs Act of 1946 | 18 U.S.C § 1951 forbids robbery or extortion which impedes or affects interstate commerce. By definition, the ATF proposal of demanding a $200 tax stamp “or else”, destroy or turn in an individual’s property, “or else”, become a felon, is extortion.

If all firearms that have a “stabilizing brace” become “short-barreled rifles”, it would effectively provide admission that “short-barreled rifles” have not made a difference in the statistics the ATF and other gun control supporting agencies provide, specifically for “crime statistics”.

Do not allow this proposal to reach fruition, as it will be a direct constitutional encroachment.
